terms of service

these terms of service ("terms") govern your access to and use of the vind website, applications, and related services (collectively, the "services").

by accessing or using the services, you agree to be bound by these terms. if you do not agree, do not use the services.

the services are provided by Protek di Davide Talevi — VAT no. IT02033660438, REA AN-265397, registered in Italy. certified email (PEC): [email protected]. this is the entity you are contracting with.

vind is not an emergency service and must not be used during a mental health crisis or other emergency.

if you are in immediate danger or believe you may harm yourself or others, contact your local emergency services immediately. if available in your country, you may also contact a local suicide prevention or mental health crisis service.

vind is not a licensed therapist, psychiatrist, psychologist, medical provider, or healthcare provider. the services are provided for general informational, supportive, and self-reflection purposes only and are not a substitute for professional advice, diagnosis, or treatment.

you must be at least 18 years old to use vind.

to use certain features, you may need to create an account and provide accurate, current, and complete information.

you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

vind may offer free access, free trials, paid subscriptions, or other paid features.

if you purchase a subscription, you authorize us and our payment processors to charge applicable fees, taxes, and recurring charges.

payments may be processed by third-party payment providers such as Stripe, Apple, or Google, as applicable.

access to voice features is subject to fair use and the limits of your subscription plan. voice allowances are calculated on a rolling basis per billing cycle and may be adjusted periodically to ensure quality of service for all users. details of the calculation methodology may evolve.

if you are a consumer in the European Union or Italy, you have the right to withdraw from a distance contract within 14 days, in accordance with the Italian Consumer Code (Legislative Decree 206/2005) and EU Directive 2011/83/EU.

because vind is a digital service supplied immediately, before access begins (including any free trial) we ask you to expressly request immediate performance and to acknowledge that, once performance has begun, you lose the right of withdrawal for the part of the service already provided; if you withdraw after performance has started, you pay an amount proportionate to what was provided up to that point.

if you do not give this express request and acknowledgement, the full 14-day right of withdrawal applies. we confirm the contract and this acknowledgement on a durable medium (by email, including payment confirmations sent by our payment processor).

subscriptions renew automatically each billing period until you cancel. prices, billing interval, and plan features are shown before you pay and may be updated for future periods with notice where required by law.

you may cancel at any time through the subscription management tools in your account settings (Stripe customer portal). cancellation stops future charges; access generally continues until the end of the current paid period unless otherwise stated at checkout.

vind may offer a free trial on the Lite plan (currently 3 days), once per user. if you do not cancel before the trial ends, the subscription converts to a paid plan at the price shown at checkout.

except where mandatory consumer law requires otherwise, fees already paid for a billing period that has started are not refundable after you have received the service for that period. chargebacks or payment disputes should be raised with us at our PEC before your bank where possible.

purchases made through Apple App Store or Google Play, if offered in the future, are subject to those stores' terms and refund rules in addition to these terms.

subject to your compliance with these terms, vind grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the services for personal, non-commercial use.

• you may not copy, modify, reverse engineer, scrape, or disrupt the services except as permitted by law;
• you may not use the services to develop or train a competing product;
• you may not use the services for unlawful, harmful, abusive, deceptive, or fraudulent purposes.

you retain ownership of content you submit through the services.

you grant vind a limited license to host, store, reproduce, process, transmit, and display your content only as necessary to operate and provide the services, maintain continuity, provide support, secure and troubleshoot the services, comply with law, and enforce these terms.

the services may use artificial intelligence and automated systems to generate responses, summaries, memory, continuity features, reminders, insights, or other outputs.

AI-generated outputs may be inaccurate, incomplete, inappropriate, biased, outdated, or not suitable for your circumstances.

you are responsible for evaluating any output before acting on it.

our privacy policy explains how we collect, use, disclose, and protect personal data. our AI disclaimer describes safety limitations and crisis resources.

you agree that we may send service-related communications, including account notices, security alerts, billing notices, support messages, and legal or policy notices.

we may suspend, restrict, or terminate access if you violate these terms, create risk or harm, use the services unlawfully, or if we are required to do so by law.

you may stop using the services at any time. account deletion and privacy requests are handled as described in the privacy policy.

to the maximum extent permitted by law, the services are provided "as is" and "as available" without warranties of any kind, whether express or implied.

nothing in these terms limits rights that cannot be waived under mandatory consumer protection law in your country of residence.

to the maximum extent permitted by law, vind will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the services.

vind's total aggregate liability arising out of or related to the services is limited to the greater of (a) the fees you paid to vind for the services in the twelve (12) months before the event giving rise to the claim, or (b) one hundred euros (€100), except where liability cannot be limited under applicable law (including death or personal injury caused by negligence, fraud, or other non-excludable liability).

you agree to bring claims within one (1) year after the cause of action arises, where such a limitation is permitted by law.

these terms are governed by the laws of Italy. if you are a consumer in the European Union or Italy, you benefit from any mandatory protections of the law of your country of residence, and you may bring proceedings in the courts of your place of residence where EU law allows.

if you are not a consumer, or where EU mandatory rules do not apply, the courts of Ancona, Italy have exclusive jurisdiction, without prejudice to vind's right to seek injunctive relief elsewhere.

we do not require EU or Italian consumers to use mandatory arbitration or to waive class or collective remedies where such waivers are not permitted by law.
